CHP: ‘Overwhelming Odor of Marijuana’ from Passing Trailer Leads to Arrest of Three

The California Highway Patrol confiscated more than 600 pounds of freshly-cut marijuana from a U-Haul trailer travelling on Highway 395 south of Ravendale Thursday.

chpincidentThree persons were arrested by the California Highway Patrol last Thursday after an ‘overwhelming odor of marijuana’ from a U-Haul trailer driving along Highway 395 south of Ravendale led to the discovery of 365 freshly-cut marijuana plants.

On the morning of September 1st, according to the report, a Susanville CHP Officer in full uniform was standing outside his vehicle talking to an Alturas CHP Officer when a gray Chevrolet pickup pulling a U-Haul trailer passed his location. As the vehicle passed him, the officer smelled the ‘overwhelming odor of marijuana’ emanating from the vehicle.

While following the pickup in his patrol vehicle the officer noticed the U-Haul trailer’s tail lights were blinking on and off, a violation of vehicle code.

Still smelling the odor from the vehicle, he conducted a traffic stop for the tail light violation and suspicion of transporting marijuana.

Approaching from the right side of the vehicle the officer contacted the driver and passengers, identified by CHP as 27 year-old Queensbury NY resident Aaron McCurry, 29 year-old Grass Valley resident Daniel J. Berry and 27 year-old Fairfield resident Caitlin Renee Carson.

When the CHP officer requested the license, registration and proof of insurance from the driver he noticed a blue colored glass smoking pipe in the vehicle. He had all the parties exit the pickup and asked them about the strong odor of marijuana coming from the trailer.

According to the CHP report both Carson and Berry produced valid doctor recommendations for medicinal marijuana. No one claimed ownership of the blue pipe.

When asked about the contents of the trailer, the report continues, Carson said it contained her personal property and the others were helping her move. No one was able to produce a key for the padlock on the trailer. The parties then began to deny it was their trailer or that they had the key.

Upon approval, via a CHP Sgt., the padlock was removed with bolt cutters. Inside the trailer were 365 freshly-cut marijuana plants weighing 640 pounds.

In the bed of the pickup seven empty gasoline fuel containers, two small gardening sheers, miscellaneous hand tools, three containers of plant fertilizer, one bag of plant fertilizer and plant pesticides were located.

McCurry, Berry and Carson were all booked into the Lassen County Adult Detention facility and held on $30,000 bail each.
